At MenuCapture ("we," "our," or "us"), we take your privacy seriously. This Privacy Policy explains how we collect, use, and protect your information when you use our AI-powered food photography service at menucapture.com (the "Service").
Key Promise: We never sell your personal data or food images to third parties. Period.
1. Information We Collect
Information You Provide
When you use MenuCapture, you provide us with account information including your email address and password, subscription details including your chosen plan and billing information, food photos you upload for AI enhancement or as reference images, payment information for your subscription which is processed securely through Stripe, prompts and descriptions you provide for AI image generation, and any support inquiries or feedback you submit.
Information Collected Automatically
We automatically collect certain technical information when you use our Service, including your browser type and version, IP address for security and fraud prevention purposes, usage data such as features used, images generated, and service interactions, basic device information including device type and operating system, and AI model usage patterns to improve our image generation quality.
What We Don't Collect
We do not collect or store credit card numbers which are handled directly by Stripe, your browsing history outside our Service, information from other apps or services on your device, or personal information beyond what's necessary to provide the AI image generation service.
2. How We Use Your Information
We use your information to provide and maintain the AI image generation Service, process your subscription payments, generate and enhance food images based on your requests, store generated images for your download and use, send important service updates and subscription notifications, respond to support requests, improve our AI models and Service based on aggregated usage patterns, detect and prevent fraud or abuse, and comply with legal obligations when required.
AI Model Training
We may use uploaded food images and generation prompts in anonymized form to improve our AI models, but only after removing all identifying information. You can opt-out of this use by contacting our support team. Generated images created for you are never used to train models for other users without your explicit consent.
3. Data Sharing and Disclosure
We Share Data Only With:
We share data only with essential service providers: Stripe for secure payment processing (they never see your food images or generation data), our hosting provider to deliver the Service and store generated images, AI infrastructure providers (like OpenAI or Anthropic) who process image generation requests but do not store your data permanently, analytics tools that receive only anonymized usage data if applicable, and legal authorities only when required by law or to protect rights and safety.
We Never:
We never sell your personal information or food images, share your uploaded photos with advertisers or other users, use your data for targeted advertising outside our Service, allow unauthorized third parties to access your account information, or distribute your generated images without your permission.
4. Data Security
We implement industry-standard security measures including encrypted data transmission using HTTPS/SSL, bcrypt password hashing, secure cloud storage for uploaded and generated images, limited access to personal data on a need-to-know basis, and regular security audits of our systems. All food images are stored with encryption and access controls. While we use commercially reasonable security measures to protect your information, no internet transmission is completely secure, and we cannot guarantee absolute security of your information.
5. Your Rights and Choices
You Can:
You have the right to access and request a copy of your personal data, update or correct inaccurate information in your account, request deletion of your account and associated data including all uploaded and generated images, export and download your generated images and account data, opt-out of AI model training using your data, and opt-out of any marketing communications. To exercise these rights, use your account settings or contact us through our contact form.
Image Ownership and Control
You own all images generated through our Service. You can download, delete, and control access to your generated images at any time through your account. Upon account deletion, all your uploaded and generated images are permanently removed from our systems.
6. Data Retention
We retain your data as long as your account is active. Generated images are stored for 90 days after creation and can be downloaded during your active subscription. After subscription cancellation, you have 90 days to download your generated content before permanent deletion. After you request account deletion, we will delete your personal data and all images from our active systems within 30 days. Backup systems may retain data for longer periods as part of our disaster recovery processes. Anonymized analytics data and any data required for legal compliance, fraud prevention, or dispute resolution may be retained as necessary.
7. Cookies and Tracking
We use essential cookies to maintain your session and preferences, and a referral attribution cookie (mc_ref, 90 days) that is set only when you arrive through a referral link and is deleted once you create an account. We do not use advertising cookies. For details, see our Cookie Policy.
8. International Data Transfers
Our servers are located in the United States and Singapore. If you access the Service from outside these regions, your data will be transferred to and processed in these countries. By using the Service, you consent to this transfer. We ensure appropriate safeguards are in place for international transfers in compliance with applicable privacy laws.
9. AI Service Providers
Our AI image generation relies on third-party AI services. When you generate images, your prompts and uploaded images may be processed by these providers (such as OpenAI, Anthropic, or other AI companies) to generate your requested images. These providers are contractually bound not to use your data for their own purposes and to delete your data after processing. We select providers based on their privacy and security standards.
10. Children's Privacy
The Service is not intended for users under 18 years of age. We do not knowingly collect personal information from children under 18. If we learn we have collected information from a child under 18, we will delete it immediately.
11. California Privacy Rights (CCPA)
California residents have additional rights under the CCPA, including the right to know what personal information we collect, the right to delete personal information (including uploaded and generated images), and the right to opt-out of the sale of personal information (which we don't do). 12. GDPR Rights (European Users)
If you're in the European Economic Area, you have additional rights under GDPR including access, rectification, erasure, portability, restriction of processing, and objection to processing. Our legal basis for processing is your consent and our legitimate interests in providing the Service. You have the right to withdraw consent for AI model training at any time.
13. Business Transfers
If MenuCapture is acquired by or merged with another company, your information may be transferred to the new owners. We will notify you before your information is transferred and becomes subject to a different privacy policy. You will have the option to delete your account and data before any such transfer.
14. Changes to This Policy
We may update this Privacy Policy occasionally. We'll notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the updated policy. For material changes affecting how we handle your images or data, we will seek your explicit consent.
